Article 26 – discrimination on the ground of sex:

Reduced pension benefits for widowers

Conclusion:

Violation of Article 26: The Human Rights Committee stated that the reduced pension benefits for widowers are discriminatory on the ground of sex. It also found the case not inadmissible under Article 5 (2) (b) because the Constitutional Court already basically adjudicated the same issue and argued that further complaints would be futile (this argument was not challenged by State).
