Article 26, Article 14 (1) – discrimination on the ground of other status:
An unemployed substitute judge, who was a civil servant on leave, was denied unemployment benefits.
Conclusion:
No violation of Article 14 (1) and 26: The Human Rights Committee stated that not every differentiation in treatment can be deemed to be discriminatory. A differentiation, which is compatible with the provisions of the International Covenant on Civil and Political Rights and is based on reasonable grounds, does not amount to prohibited discrimination.
